Margate Police to enforce city Noise Ordinance

Margate Police Chief, Jerry Blough announced at City Hall Wednesday night that the Margate Police Department (MPD) will be aggressively enforcing the city’s noise ordinance on July 4th.  This, in response to a question posed by Margate Commissioner Frank Talerico as to whether fireworks are illegal in Margate.

According to the Chief, “the only thing we really have is a noise ordinance,” said Blough, adding that there is no law in Margate that expressly prohibits the possession of fireworks.

The noise ordinance the Chief speaks to reads: “Impulsive sources.  The using of fireworks, explosives or the firing of guns or other explosive devices without first obtaining a permit,” listed under Sec. 17-79 of Specific Prohibitions in Margate Municode.

In addition, the storage and / or use of any type of ‘fireworks’ in Margate requires a permit approved by the city’s fire department, as indicated by General Provisions in the code

Although in the past, cities with similar laws may have looked the other way regarding the possession and use of Class C fireworks (the kind you buy at Publix and from roadside fireworks vendors) – that could change, especially for residents in possession of Class A and Class B fireworks, the types professionals use.

Any of us who have lived in Margate for years are familiar with the dense gray smoke that fills the air of our neighborhoods early in the morning of July 5 – a direct result from fireworks going off into the wee hours.  

This year, Margate cops will be less tolerant to residents disrespecting the city’s noise ordinance and / or jeopardizing neighbor’s safety and health by the careless use of high-powered fireworks and explosives, such as dynamite, M-100s and the like.

Chief Blough said the MPD receives numerous complaints regarding the same residents every year and has made it clear that the MPD will be keeping a close eye on those residents and issuing citations.
